Not Guilty Verdict in Nassau County DWI Trial

Our client was charged with misdemeanor Driving While Intoxicated (DWI), Driving While Ability Impaired (DWAI), and several traffic infractions in Nassau County after being stopped in the early morning hours for driving without headlights. 

Despite a blood alcohol concentration (BAC) of just 0.09, the Nassau County District Attorney’s Office pursued jail time of nine months due to our client’s prior criminal history and refused to offer a plea reduction.

At trial, we retained a leading expert in breath testing, whose testimony cast serious doubt on the reliability of the breathalyzer results. 

Through strategic cross-examination of the prosecution’s breathalyzer technician, we demonstrated flaws in the machine and the testing process. After two days of deliberation, the jury acquitted our client of the misdemeanor DWI charge.

While the jury found our client guilty of the lesser violation-level DWAI, the acquittal on the DWI charge significantly reduced his exposure to jail time. Instead, the judge imposed a sentence of community service. (People v. G.L.)
